Health care sector roils after ACA court ruling

Sen. Susan Collins, R-Maine, is speaking out against a federal judge's ruling overturning the Affordable Care Act, commonly known as Obamacare.

That Texas judge ruled the law unconstitutional after republicans in congress eliminated the individual mandate requiring everyone to buy insurance a year ago.

In 2012, a Supreme Court ruling found that the individual mandate could be interpreted as an excessive of Congressional taxation power. In Trump's first major legislative failure, the late Republican Senator John McCain voted to keep the ACA on the books with a famous down-thumbs vote on a repeal measure in July 2017.

O'Connor's ruling "exposes the monstrous endgame of Republicans' all-out assault on people with pre-existing conditions and Americans' access to affordable health care", Pelosi said in a statement.

In a ruling that could throw the nation's health care system into chaos, Fort Worth-based U.S. District Judge Reed O'Connor on Friday ruled that a major provision of the Affordable Care Act is unconstitutional - and that the rest of the landmark law must fall as well. Supporters of the law immediately said they would appeal.

But with that "tax" - or penalty - having been removed starting next year, Republicans challenging the law in this case argued the program is now illegal. Nearly exactly one year after passing the tax-reform package that eliminated the individual mandate in ObamaCare, Republicans got the ruling they wanted on Friday. "The Republicans have no alternative to the Affordable Care Act, and they've been refusing up until this point to even sit down sit down (to discuss) improvements and changes", Durbin said.

Though the federal government would have paid for Medicaid expansion for the first few years, MS would have had to pay 10 percent of the cost of expansion in later years.
